IHC stops govt from blocking mobile phone SIM of non-filers

blocking mobile phone SIM: The Islamabad High Court (IHC) on Tuesday restrained the government from blocking mobile phone SIMs of non-filers.

IHC Chief Justice Aamer Farooq passed the order on a mobile phone company’s plea against the Federal Board of Revenue’s (FBR) move to block SIM cards of prospective taxpayers who do not file returns.

The Chief Justice has issued a stay order till May 27 on the plea of ​​the mobile phone company and restrained the government from blocking the SIMs of tax non-filers.

It is recalled that the FBR and telecom operators recently signed an agreement to block SIMs of non-filers and the process was initiated on May 10 when over 3,000 SIMs of non-filers were blocked in the first phase.

Earlier this month, the federal government directed the Pakistan Telecommunication Authority (PTA) and other telecom companies to block the mobile phone SIMs of 500,000 non-filers.

In a statement, the Federal Board of Revenue (FBR) said: “In exercise of the powers conferred under Section 114B of the Income Tax Ordinance, 2001, the FBR is pleased to issue this Income Tax General Order (ITGO) to disable mobile. Phone SIM in respect of the following persons who do not appear in the list of active taxpayers but are liable to file income tax returns for the tax year 2023 under the provisions of the Income Tax Ordinance, 2001.”

FBR has asked PTAs and all telecom operators to ensure compliance with the Income Tax General Order (ITGO) with immediate effect. ”

The mobile SIM in respect of the above persons shall remain blocked until reinstated by the FBR or the Commissioner Inland Revenue having jurisdiction over the person.”
